New York Expands Packaging Law to Include PFAS Restrictions

New York state is considering ways to reduce the presence of PFAS in the environment. According to Environmental Conservation Law, no person shall distribute, sell, or offer for sale in this state food packaging containing PFAS substances as intentionally added chemicals on or after December 31, 2022. Retailers and food service businesses must confirm if the packaging products they are distributing, selling, or offering for sale adhere to the PFAS prohibitions in the law. They need to determine whether these products contain PFAS that have been added intentionally. A certification of compliance supplied by the distributor or manufacturer may be used to make such determinations in accordance with the law.
