Federal Trade Commission (FTC) issues a guidance document on health-related products

FTC issued a guidance document titled "Health Products Compliance Guidance" by updating "Dietary Supplements: An Advertising Guide for Industry" guide which was issued in 1998.|This document provides guidance to ensure that the claims about the benefits and safety of health-related products like dietary supplements or other health related products, including foods, over-the-counter (OTC) drugs, homeopathic products are truthful, not misleading.|Sections 5 and 12 of the FTC Act, along with the FTC’s policy statements on deception and advertising substantiation, are the foundation of FTC truth-in advertising law, and can be distilled down to two principles:| 1. Advertising must be truthful and not misleading; and|2. Before disseminating an ad, advertisers must have sufficient evidence for all objective product claims conveyed, expressly or by implication, to consumers acting reasonably.
