South Korea Optimizes the Regulation of General Food with Functional Claims

The Regulation on Exceptions of Prohibited Labels and Advertisements of Food Function Claims was updated on March 8, 2023, by the Ministry of Food and Drug Safety (MFDS).  In order to better direct the business, the new version primarily clarifies the regulation's ambiguous requirements.

First, the daily intake of "individually recognized ingredient" now serves as a guide in addition to the recommended daily intake when determining the functional material's recommended daily intake quantity.

Previously, the contents of the functional components were needed to "exceed 30% of the recommended daily intake stipulated in Health Functional Food Code, whilst less than the maximum permissible contents".

The daily intake of the functional material in the general food with functional claims is also permitted to exceed 30% of the daily intake of the "individually recognized ingredients" under the revised form.
